Welcome to Kooksey - Independent UK Maker of Gothic bags & accessories. These terms govern your use of this website and the purchase of any goods from the Shop (referred to on this website as The Vault). By placing an order, you agree to be bound by these terms.
1. THE CONTRACT
When you place an order, you will receive an automated acknowledgment email. This is not an acceptance of your order. A contract between us is only formed when I send you confirmation that your order has been accepted. We reserve the right to decline any order.
2. MADE-TO-ORDER & PRICING
The Build Cycle: As stated across the site, each piece is made to order. Please allow 7 working days for production before dispatch. If at the time your order is placed, I will not be able to meet this deadline, I will contact you to advise a revised timeframe. You will have the option to reconfirm the new dispatch timeframe or cancel.
Pricing: All prices are in GBP (£). We reserve the right to change prices, but this will not affect orders already confirmed.
Errors: In the rare event of a pricing error, we will contact you. You will have the option to reconfirm at the correct price or cancel.
3. SHIPPING & DELIVERY
We ship from the UK. Delivery estimates are provided by our carriers and are not "guaranteed" dates.
International Orders: If you have contacted me to discuss shipping overseas and confirmed you are happy to proceed based on the shipping charges quoted, you (the buyer) are responsible for any additional import duties, taxes, or customs clearance fees required by your country.
4. CANCELLATIONS & RETURNS (UK Law)
Under the Consumer Contracts Regulations, you generally have a 14-day "cooling-off" period. However:
Personalised/Custom Goods: If we have agreed on a "Custom Build" or modification specifically for you, these items are non-refundable unless they arrive faulty.
Standard Items: You have 14 days from receiving your goods to notify us of a return. You are responsible for the cost of return shipping. Items must be returned in their original, unused condition.
5. FAULTY GOODS
If a product arrives with a genuine "DNA fault" (manufacturing defect), please contact the me (the Curator) immediately. I comply with the Consumer Rights Act 2015, which entitles you to a repair, replacement, or refund for faulty goods.
6. INTELLECTUAL PROPERTY
All content, designs, and "Kooksey" branding are the property of the Curator.
7. LIMITATION OF LIABILITY
We are not liable for any indirect losses or "incidental" damages. Our total liability to you for any order will not exceed the price paid for the goods.
8. GOVERNING LAW
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
